Four months after filing a petition and SC issuing notice on his bail plea in Elgar Parishad case, former DU professorHany Babu Friday sought to withdraw his petition which was allowed by the court.
Appearing before a bench of Justices Bela M Trivedi and Pankaj Mithal, Babu’s lawyer said that she wanted to withdraw the petition as there had been a change in circumstances as five co-accused have been granted bail.Allowing the plea, the court passed a brief order and said, “The counsel for the petitioner states that there is a change in the circumstance and she would not like to press the present petition and approach the high court… In view of the above, the petition is dismissed as not pressed”.
Interestingly just a month back on April 5, a bench of Justices Aniruddha Bose and Augustine George Masih granted bail to 66-year old former Nagpur University professor Shoma Sen in the Elgar Parishad case, saying that all the allegations against her for indulging in terrorist activity and working for banned naxal outfit are prima facie not true.
The apex court had on Jan 4 sought response from National Investigation Agency (NIA) on bail plea of Babu who has been in custody since 2020 in the case.
He approached the court after his bail plea was rejected by Bombay High Court in September last year. While rejecting his bail plea, the HC had said that offences that he was accused of were serious and evidence showed that he “was an expert in setting up appointments and developing code structure which was vital for secret communication.”
Babu was arrested in July 2020 on charges of being a member of the banned Communist Party of India (Maoist).
